Aspose, is a technology company focused on building the best software products in the world. In order to maintain that focus we have a small business team, so that we can have a greater number of developers and support staff. The time and costs associated with negotiating and managing custom agreements is high; therefore, our agreement policies must be more conservative so that we can continue to build better products and services.
##### Pre-purchase Agreements
Pre-purchase agreements are any agreements requested prior to a purchase being made. Examples include nondisclosure agreements, evaluation agreements and other similar documents. Aspose is unable to accommodate any pre-purchase agreements. Our [End User License Agreement](/legal/eula) contains language for evaluations, and confidentiality. The terms of the End User License Agreement apply once an evaluation is installed, so it’s possible the End User License Agreement may contain the types of assurances requested in other pre-purchase agreements.
##### Customized License Agreement
Aspose is willing to accept limited changes to our End User License Agreement. All changes must be made in the Aspose agreement wizard. The wizard outlines areas of the license agreement that Aspose is willing to change, to minimize negotiation time, in order to make efficient use of our clients’ time and resources.
One must be willing to purchase Enterprise Support in order to negotiate a custom license agreement. More information regarding Enterprise Support can be found in the [support section](https://helpdesk.aspose.com/kb/faq.php?id=3). If negotiations are unsuccessful, then there is no obligation to purchase Enterprise Support. Contact the [sales team](/contact) for access to the Aspose agreement wizard.
The negotiation of a customized license agreement is expected to be fully concluded in a reasonable time. In the event an agreement cannot be settled upon in a timely manner Aspose reserves the right to charge an additional fee.
##### NDA
In Section 7 of the [End User License Agreement](/legal/eula). there is NDA style language. When sharing sensitive content with any Aspose Team Member, simply include a “Confidential Information” note and any data or files will be covered and treated with the utmost confidentiality. Aspose is unable to make any additional warranties aside from what is included in the End User License Agreement.
##### Questionnaires and Forms
Aspose has limited administrative resources which is why we decline to fill out long questionnaires or forms. Where possible we will provide you with the documents or links to our website where you can find the information yourself. If the forms are necessary for your purchase and we are unable to oblige then we will direct you to a local reseller who can assist with those forms and the purchase of our products on our behalf.

# Customer Data And Security

We run our services to ensure maximum uptime while focusing on the security of any customer data.
Infrastructure
Aspose's customer facing services are delivered via Amazon Web Services (AWS), the largest and leading provider of cloud infrastructure. Millions of customers in hundreds of countries, including government agencies, educational institutions and non-profits trust AWS every day with their infrastructure and data.
Using an industry standard like Amazon helps guarantee the security and resilience of our services. Amazon has attained a number of certifications that affirm that they have stringent, working internal controls.
Physical Security
Amazon safeguards the physical security of their servers. Servers are located in non-descript facilities, and critical facilities have extensive setback and military grade perimeter control. Access to data centers requires two-factor authentication at three points.
Server and Data Security
Host operating systems are kept secure by internal processes and procedures. Guest operating systems are entirely controlled by Aspose. Amazon administrators do not have access to them. By default, inbound firewall rules deny all traffic to host servers.
Backups and Disaster Recovery
All critical and production systems are backed up nightly using full system snapshots. Backups are tested periodically.
All backups are encrypted, securely transmitted and stored within the Amazon S3 storage service which allows for data to be stored on no less than three physically independent devices for security and resilience.
All access is logged and tracked for auditing purposes.
Maintaining Privacy
Account passwords are encrypted and filtered out from all application and system logs. Passwords are not visible to anyone.
Sign out of your Aspose account to prevent someone from using your computer to access your account without your authorization. Keep your user name and password secure and do not disclose it to any third-party. In case a third-party gains unauthorized access to your account due to any act or omission on your part, you are solely responsible for any loss caused.
Credit Card Safety
Aspose does not retain any credit card information provided by you. When we charge your credit card, such information is transferred directly to, and processed by, our payment gateway.
To protect user information, Aspose's payment gateway uses the latest 256-bit Secure Socket Layer (SSL) technology for secure transactions. The payment gateway is certified as compliant with card association security initiatives including Payment Card Industry (PCI) and Cardholder Information Security Program (CISP) standards for data protection.
GDPR Compliance
Aspose is GDPR compliant, read our GDPR policy here, we also maintain a list of the Subprocessors we use on this page.
File Retention Policy
Aspose products run on customer's own machines, infrastructure and network and do not send any files back to Aspose for processing and therefore does not have access to them.
The one exception to this is where a customer has access to an Aspose Metered License. These licenses report usage information to our servers for billing purposes. The reported data only includes usage information, no other statistical information can be derived from this reported information.
From time to time a customer may send documents to the Aspose support team via the forums for the purpose of diagnosis of technical issues or feature requests. These files are maintained only as long as necessary to complete the required task and the customer can ask for these files to be removed at any time.
If the customer marks a thread as private none of these files are accessible to any person other than the customer and select Aspose staff.
Each core Aspose system as well as several non-essential systems are monitored to ensure they are always contactable and functional.
We offer a public service status portal which lists historical downtime incidents and resolution notices. This provides real-time information in the event of any service disruption.
Uptime monitoring is accomplished using an externally hosted platform which notifies a company wide alerting system when any monitored services have issues.
We provide real-time status alerts of any system status changes, these can be subscribed to via RSS, ATOM or email.
We take the intellectual and proprietary rights of others seriously and require that our users do the same. The Digital Millennium Copyright Act (DMCA) established a process for addressing claims of copyright infringement.
If you own a copyright or have authority to act on behalf of a copyright owner and you believe that your copyrighted works or materials are improperly posted, displayed or accessible on any website that is owned or controlled by us, please send a notice that meets the minimum requirements of the DMCA, listed below, to dmca@aspose.com. Please note that we are a paperless company and we do not accept notices sent to our mailing address.
Once we receive your DMCA notice, we will review it, make a determination on the infringement and notify you of the outcome in a timely manner. If we find that the DMCA requirements have been satisfied, we will remove the infringing content as quickly as possible.
##### DMCA notice requirements
The DMCA notice must include the following:
- A description of the copyrighted work you claim is being infringed or, if the claim involves multiple works, a representative list of such works.
- A description of the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled, including at a minimum, if applicable, the URL of the link shown on the site or the exact location where such material may be found.
- Adequate information by which we can contact you (your name, title, if acting as an agent, address, telephone number, and email address). Note portions or all the information you submit may be provided to third parties (e.g., the uploader of the material).
- The following statement: “I have a good faith belief that the use of the copyrighted material I am complaining of is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)”.
- The following statement: “The information in this notice is accurate and, under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right that is allegedly infringed”.
- Provide your full legal name and your electronic or physical signature.
Before you file your DMCA notice, please carefully consider whether or not the use of the copyrighted material at issue is protected by the Fair Use doctrine. If you file a DMCA notice when there is no infringing use, your request may be rejected. If you are unsure whether someone’s use of your copyrighted material amounts to infringement, please seek legal advice. You may also want to consult publicly available reference materials.
##### Removal of Non-DMCA Content
*If you uploaded a document containing sensitive or confidential information that you want removed then do not submit a DMCA notice. ##### Other Disputes

#### 1\. Is the same EULA for all downloads products used by Aspose also used for your other websites?
Yes! All products from all [our websites](https://websites.aspose.com) that provide self hosted download products use the [same EULA](/legal/eula).
This reduces the time and complexity for legal departments in companies who utilize different sets of our products.
#### 2\. Our legal department would like to make some changes to your End User Agreement. Is that acceptable?
Aspose is willing to accept limited changes to our End User License Agreement. All changes must be made in the Aspose agreement wizard. For more information check [Custom Agreements](/legal/custom-agreements).
#### 3\. Your EULA refers to the grant of Publicity Rights. What does that mean? Can we opt out?
We list a small number of our customers on our website as examples of organizations using our software. If you do not want us to mention your company name at all, just [contact us](/contact) and we'll add you to our list of companies requesting not to be party to future disclosures or forms of publicity (including our customer lists on our website).
#### 4\. Your EULA refers to data that may be collected and stored. Can you provide more details?
The only customer data that we currently maintain within our own internal systems is customer and transaction information (i.e. purchase history), as well as anything that you may (or may not) elect to share with us via our support system. The product itself does not collect information.
#### 5\. Do your products contain any open source software?
A list of any open source software embedded in the products is provided alongside the binaries. This is a text file beginning with "thirdpartylicenses" in the installation directory under the _License_ folder.
#### 6. Does Aspose make commitments to its customers with regard to the GDPR

### **Aspose and the GDPR**
On the 25th May 2018 the European Union began enforcing its General Data Protection Regulation (GDPR). It impacts how businesses collect and process data from European individuals. While Aspose is an Australian Business with no European entity, it values the rights of its users’ and customers and their personal data regardless of their location. As such we’re working hard to comply with these rules across all our systems and processes.
This page gives an overview of the roles described by the GDPR, the responsibilities of each party and the efforts we’re putting in place to support these recommendations.
### **Aspose as the data processor**
While using our services you may upload files for processing via our Cloud API platforms, you may also send our Support Team files for debug or support purposes. Due to the nature of our products and services, your files may contain information from or about your clients. While covered by the confidentiality clauses in our EULA, the upcoming updates to our Terms of Use and Privacy Policy further cement these rights.
These are your data subjects, and you are considered the data controller for this personal data. Our Terms of Use and Privacy Policy refer to this data as Client Data.
Using Aspose services to process your Client Data means that you have engaged Aspose as a data processor to carry out certain data processing activities on your behalf. Article 28 of the GDPR states that the relationship between the controller and the processor needs to be made in writing (electronic form is acceptable under subsection (9) of Article 28). Our Terms of Use and Privacy Policy also serve as your data processing contract with Aspose. They set out the instructions you are giving to Aspose in regards to processing personal data you control and establishing the rights and responsibilities of both parties. Aspose will only process your Client Data based on your instructions as the data controller.
### **Data Transfers**
When data is transferred outside of the European Economic Area (EEA) by data processors, the GDPR sets strict requirements for moving data outside of the scope if its protection.
As Aspose is an Australian business with no European entity, the data controller makes the sole decision to transfer data to Aspose which is based in Australia outside of the EEA, with its technical infrastructure based in the US. Where we do engage with sub-processors we do so in a considered fashion considering the legalities of the transfer at each step.
We’ll keep an up-to-date list of sub-processors in our Terms of Use. This ensures we are fully transparent about our transfers and the processors we use. We’ll explain the data we transfer and for what purpose. We only engage with sub-processors who have either certified under the EU-US Privacy Shield framework or signed the EU Commission’s standard contractual clauses for data transfers with us.

### **Aspose as the data controller**
Aspose acts as the data controller for the personal data we collect about you, the user of our web apps and website, the purchaser of our products or services.
Secondly, we process data to meet our obligations under the law (GDPR Article 6(1)(c)) — this primarily involves financial data and information that we need to meet our accountability obligations.
Thirdly, we process your personal data for our legitimate interests in line with GDPR Article 6(1)(f).
### **What do you mean by ‘legitimate interests’?**
- Improving our products and services in a way is useful to you.
- Ensuring your data and Aspose’s systems are reliable, safe and secure.
- Responsible marketing of our products, services and their features.
- The ability to service the contract we are entering into with you, our customer.

### **What is Aspose doing for the GDPR**
Aspose respects the privacy of its customers and their clients. To that end, we have implemented and continue to improve both technical and organizational measures in line with the GDPR to ensure the appropriate processing of personal data.
### **Internal processes, security and data transfers**
We have reviewed our internal processes and operations to make sure we map and audit the data travelling through our systems. We are implementing functionality within all our main customer facing systems to cope with the principles of Privacy by Design. Any access to Client Data is only done through the permission of our customers and is always limited and specifically in scope to the contract between Aspose and its customers have engaged in.
Our internal procedures and logs make sure that we meet the GDPR accountability requirements.
We onboard new third-party services rarely, but when we do we have an internal process for evaluating these suppliers on their security and privacy considerations. We keep the number of sub-processors to a minimum, where possible using our own technology and infrastructure for processing.
### **Ability to action subject access requests**
Data subjects’ ownership of their personal data is at the heart of the GDPR. We are working on a plan to respond to data subject requests to delete, modify, or transfer their data. This means that our Customer Support Specialists along with the Engineers that assist them in their work are well-prepared to help you in any matters involving your personal data.
### **Documentation**
Our Terms of Use and Privacy Policy are updated regularly to make sure we build upon the good work we’ve always done in this area. As these documents set out the basis of our relationship with you, it is of paramount importance for us to openly and clearly explain your rights in these documents.
### **Training and awareness**
Training and awareness about GDPR, the handling of and processing of Personal Data have been communicated throughout the whole Aspose Business. Each Aspose Team Member has awareness of the issues and our policies surrounding the compliance with GDPR and other Privacy related issues. We have built this training into our new team member training requirements and have scheduled refresher checks regularly.

# Intellectual Property Theft

Intellectual Property Theft is the illegal decomplilation, repurposing, wrapping, reverse engineering and distribution of Aspose's products. It is illegal because it breaks Aspose's license agreement and infringes on our copyright and intellectual property rights.
Developers who have to work with stolen software can find themselves unable to get updates, fixes and support. They may also be using a product that has malicious code embedded within it. If Aspose prosecutes Intellectual Property theft cases, the perpetrator may be forced to remove products or even cease trading. This type of situation could cause genuine customers serious issues if they are using stolen products in production environments.
Intellectual Property Theft can be easy to spot:
Another vendors documentation or API looks very similar to the Aspose equivalent.
The output from a stolen product contains Aspose watermarks, metadata or expired Temporary License information.
The output from a stolen product looks identical to the equivalent output from an Aspose product.

Aspose cares deeply about the environment and acts responsibly to avoid any negative environmental impact. As such, Aspose has a strict paperless policy meaning we do not send paper to customers and aim to reduce incoming paper to our offices to as close to zero as possible.

### 2. Information we Collect
Aspose takes online security very seriously and is committed to protecting your privacy. In order to access some Aspose services you will be asked to provide personal identification information ("Personal Information"). How, why and other information in regards to this is explained below.
In general, you may visit Aspose's web pages without disclosing to us who you are and without revealing any Personal Information about yourself however without providing personal information you may not be able to download or purchase our products or services.
#### 2.1. Collection of User data
During a registration on the Aspose website, you give consent to provide information such as name, company name, email address, physical address, telephone, credit-card number and other relevant data. This information is used by Aspose to identify you as a User and provide you with access to:
- purchase our software,
- use support and services
- participate in mailings, sales and marketing actions,
- for billing purposes
- to meet any other contractual obligations
We do not collect sensitive information such as medical, health, racial, ethnic, political, religious, philosophic, union membership or sexual orientation information. If we are made aware that we have received such information, we will promptly proceed to its deletion.
In some cases another User (such as a system administrator) may create an account on your behalf and may provide your information, including Personal Information (most commonly when your company requests to use our products). We collect Information under the direction of our customers and often have no direct relationship with the individuals whose personal data we process.
If you are providing information (including Personal Information) about someone else, you must have the authority to act for them and to consent to the collection and use of their Personal Information as described in this Privacy Policy.
#### 2.2. Data Access, Correction, Deletion, and Opt Out.

Users may create more Users within their account (sub accounts). Once these new Users log into Aspose, they meet the definition of User in this policy. Aspose will not retain User data longer than is necessary to fulfil the purposes for which it was collected or as required by applicable laws or regulations.
To the extent that you do provide us with Personal Information, Aspose wishes to maintain it accurately and up-to-date. Where we collect Personal Information from you, our goal is to provide a means of contacting Aspose should you need to access, update or correct that Information.
You can contact us any time to:
- Request access to information that Aspose has about you
- Correct any Information that Aspose has about you
- Delete information that Aspose has about you
Contact us at sales@aspose.com and we will make reasonable efforts to promptly provide you with the information or assistance you need free of charge.
Further, if you notify us that such information is incorrect, or you wish to have such information removed, we will correct, amend, or delete your Personal Information as soon as practicable. Your personal data will be removed without the requirement to state a reason for discontinuing your account with us.

Aspose processes Personal Data both as a Processor and as a Controller, as defined in the Directive and the GDPR:
Aspose which you as a User entered an agreement with when signing up for an account, will be the Controller for User data, as outlined in the information above.
Using some Aspose services you may send your own client’s (“Client”) data through our servers, in this case you the User will be the Controller in accordance with Directive and GDPR, and Aspose will be the Processor. Aspose adheres to the Directive of 1995 and the GDPR from May 25th, 2018.
Aspose does not own, control or direct the use of any of the Client data stored or processed by a Client or User via the Service. Only the Client or Users are entitled to access, retrieve and direct the use of such Client Data. Aspose is largely unaware of what Client Data is actually being stored or made available by a Client or User to the Service and does not directly access such Client Data except as authorized by the User, or as necessary to provide Services to the Client and its Users. As such Aspose is not acting in the capacity of data controller in terms of the European Union’s General Data Protection Regulation (Regulation (EU) 2016/679, hereinafter “GDPR”) and does not have the associated responsibilities under the GDPR.
Aspose should be considered only as a processor on behalf of its Clients and Users as to any Client Data containing Personal Data that is subject to the requirements of the GDPR. The Client or the User is the data controller under the Regulation for any Client Data containing Personal Data, meaning that such party controls the manner such Personal Data is collected and used as well as the determination of the purposes and means of the processing of such Personal Data.

You should be aware, that if you choose to provide us with your Personal Information, we may transfer such information, within Aspose or to Aspose's third party service providers, across borders and from your country or jurisdiction to other countries or jurisdictions around the world, subject to the limitations of this Privacy Policy.
Personal data collected by Aspose will be stored in secure hosting facilities provided by Amazon Web Services located in the US which is on the EU Commission’s list of countries or territories providing adequate protection for the rights and freedoms of data subjects in connection with the processing of their personal data. In the course of providing the Service, your files are transferred to and temporarily stored on Aspose’s servers. We do not read or mine any data from your files or their metadata, and we do not make any copies of them. All file processing is done by machine; there is no human interaction with your files unless they are submitted by you to our support team in the support forum. Your files are automatically irreversibly deleted from our servers within 24 hours.

From time to time, Aspose will provide information to their customers in the form of electronic newsletters. When you subscribe to the Aspose newsletter you will be added to our mailing list and will receive announcements and information about Aspose and its ventures. License abuse is the illegal and unauthorized reproduction, distribution and/or use of software and software licenses. It is illegal because it breaks the license agreement and infringes on the originator's copyright and intellectual property.
Developers who have to work with unauthorized software can find themselves unable to get updates, fixes and support. If a product has been modified to work without a license, users of that software can't be sure that it hasn't been tampered with in other ways. If software isn't authorized, don't depend on it.
Aspose regularly checks for license files that have been made public and may blacklist these licenses without warning. We will only reinstate licenses once the public versions have been removed. We encourage all customers to be mindful of the potential of license leakage through the distribution of derived works with Aspose products contained within them or using public source control repositories.

The following are terms of a legal agreement between you and Aspose Pty Ltd, also known as Aspose who maintains this website. By accessing, browsing, and/or using this web site, you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations. Information on this web site may contain technical inaccuracies or typographical errors. Information may be changed or updated without notice. Aspose may also make improvements and/or changes in the products and/or the programs described in this information at any time without notice.
The security procedures and measures Aspose users is publicly available at security practices which is incorporated herein by this reference and which may be updated from time to time. In regards to the protection of user data, Aspose will maintain administrative, physical, and technical safeguards for protection of the security, confidentiality and integrity of User Data as described in the security policy above. Those safeguards will include, but will not be limited to, measures for preventing access, use, modification or disclosure of User Data by Aspose personnel except (a) to provide the Service and prevent or address service or technical problems, (b) as compelled by law in accordance, or (c) as a User or User expressly permit in writing.
The Services are performed using equipment or facilities located in the United States. Aspose's US service providers are either Privacy Shield compliant or have executed Standard Contractual Clauses (as approved by the European Commission). This provides legal grounds for assuring that, when processed in the United States, the personal data of EU citizens that are processed by Aspose customers when using the Service will receive from Aspose and its service providers located outside the EU an adequate level of protection within the meaning of Article 46 of Regulation (EU) 2016/679 (General Data Protection Regulation).
By agreeing to these Terms, the User grants Aspose a general authorization in the meaning of Article 28 (2) of Regulation (EU) 2016/679 to engage processors for the purposes of providing the Service. The list of processors Aspose uses is publicly available at subprocessors. Aspose will inform the User of changes in such processors in accordance with the procedure of modifying these Terms as stipulated in this agreement.
For the purposes of Article 28 of Regulation (EU) 2016/679, these Terms constitute the data processing contract between the User (data subject) and Aspose as both the data controller and the data processor (Aspose are the data processor in instances where the User makes use of a Metered License). The User hereby instructs Aspose to control and process the data as described in these Terms.
Subject matter and nature of processing. Aspose provides a Service whereby to access the User must sign up for an account which involves the supply of personal information. Aspose collects and uses customer info to send newsletters, keep purchase records, retain forum posts. With a Metered license Aspose also acts as the processor of usage data.
Duration. Aspose will collect data on behalf of the User until the termination of the User's account. Upon termination, Aspose will store the User's data for a period of 7 days, should the User wish to reopen the account to resume the use of the Aspose's Service or to export data, unless instructed otherwise by the User. Aspose deletes or returns all the personal data to the User after the end of the provision of services relating to processing, and deletes existing copies unless Union or Member State law requires storage of the personal data.
Parties’ rights and obligations. The User's rights and obligations regarding User Data are provided in these Terms. Aspose ensures that persons authorised to process the personal data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality. Aspose takes all measures required pursuant to Article 32 of Regulation (EU) 2016/679 and we undertake to make available to the controller all information necessary to demonstrate compliance with their obligations and to allow for and contribute to audits, including inspections, conducted or mandated by the User.
Unlawful Client Data. Aspose is not obliged to pre-screen, monitor or filter any User Data or acts of its processing by the User in order to discover any unlawful nature therein. However, if such unlawful User Data or the action of its unlawful processing is discovered or brought to the attention of Aspose or if there is reason to believe that certain User Data is unlawful, we have the right to:
notify the User of such unlawful User Data;
deny its publication on the Web Site or its insertion to the System;
demand that the User bring the unlawful User Data into compliance with these Terms and applicable law;
temporarily or permanently remove the unlawful User Data from the Web Site or Account, restrict access to it or delete it.
If Aspose is presented convincing evidence that the User Data is not unlawful, we may, at our sole discretion, restore such User Data, which was removed from the Web Site or Account or access to which was restricted.
In addition, in the event Aspose believes in its sole discretion User Data violates applicable laws, rules or regulations or these Terms, Supplier may (but has no obligation), to remove such User Data at any time with or without notice. Without limiting the generality of the preceding sentence, Aspose complies with the Digital Millennium Copyright Act, and will remove User Data from the Platform upon receipt of a compliant takedown notice.
Aspose as the data controller and data processor will assist the User as the data subject in meeting the User's obligations under Regulation (EU) 2016/679, providing subject access, and allowing data subjects to exercise their rights under Regulation (EU) 2016/679.
Aspose assumes no responsibility regarding the accuracy of the information that is provided by Aspose and use of such information is at the recipient's own risk. Aspose provides no assurances that any reported problems may be resolved with the use of any information that Aspose provides.
By sending Aspose any information or material, you agree that Aspose and its affiliates may collect and use technical information, excluding any confidential information, gathered as part of the product support services provided to you. Aspose may use this information solely to improve our products or to provide customized services or technologies to you.
